I/We indicate that I/We have read and understood this Media Release. I know this is a release of liability, and I voluntarily agree to its terms.

I/We hereby understand and acknowledge that the training, programs, classes and events held by Court 16, Inc. may expose me or my child to many inherent risks, including accidents, injury, illness or even death. I/We assume all risk of injuries for me or my child associated with participation in Court 16, Inc. activities including, but not limited to, falls, contacts with other participants, equipment or tennis balls, and all other such risks being known and appreciated by me.

I/We accept full responsibility for the use of any and all equipment, facility privilege or service whatsoever, owned and operated by this club at my/our own risk and shall not hold this Court 16, Inc., its shareholders, officers, employees, representatives, and agents liable for any and all loss, claim, injury or liability sustained or incurred during voluntary participation at Court 16, Inc. and their programs.

I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with my participation or the participation of my child in any activity. I/We acknowledge that I/We or my child are physically fit and mentally capable of performing the physical activity I/We choose to participate in.
After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and/or the participation of my child in the services provided to me/my child by Court 16, Inc., I agree, for myself, and anyone acting on my behalf, to HOLD HARMLESS, WAIVE, and RELEASE Court 16, Inc, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands of every kind, losses, injuries, property damage or claims or any kind arising out of my participation and/or the participation of my child in Court 16, Inc. activities or events; or arising out of the use or intended use of any facilities, equipment or other property of Court 16, Inc; and I/We covenant not to sue therefore.

I hereby attest and verify that I have full knowledge of the risks involved in Court 16, Inc. activities, that I assume those risks, that I will assume and pay my own medical expenses and emergency expenses in the event of accident, illness or other incapacity, regardless of whether I have authorized such expense.

I further agree to provide any appropriate medical information to Court 16, Inc. if I am required to by Court 16, Inc. In addition, in case of accident or injury to me and/or my child and if an emergency contact person cannot be reached, I grant Court 16, Inc. permission to obtain medical attention if necessary, for which I will be financially responsible.

I understand and agree that Court 16, Inc. is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

COVID - 19 Waiver and Release

Using the measures and guidelines provided by the State of New York, the US Tennis Association, I understand that Court 16, Inc. has put in place enhanced health and safety measures to reduce the spread of COVID-19, I also understand that Court 16, Inc. cannot guarantee that I or my child(ren) will not become infected with COVID-19.

By signing this agreement and visiting and using the facilities of Court 16, Inc. I acknowledge that an inherent risk of exposure to COVID-19 exists in any public place where people are present. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Court 16, Inc. and that such exposure or infection may result in extreme illness, permanent disability, and possibly death.

I understand that the risk of becoming exposed to or infected by COVID-19 at Court 16, Inc. may result from the actions, omissions, or negligence of myself and others, including but not limited to Court 16, Inc. employees, volunteers and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury, to my child(ren) or myself (inlcuding but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Court 16, Inc. or participation in Court 16, Inc. programming (“Claims”)

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Court 16, Inc., its employees, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes and Claims based on the actions, omissions, or negligence of Court 16, Inc., its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Court 16, Inc. program.

I/We indicate that I/We have read and understand this Waiver of Liability and Waiver and Release of COVID - 19. I know this is a waiver and a release of liability, and I voluntarily agree to its terms.
